Jenkins & Jones Terms of Use

Jenkins & Jones is a brand of ZCC Media Agency, a business run by Zion Boggan ("we", "us"). These terms cover the Jenkins & Jones website at jenkinsjones.net and anything we deliver through it, including reports, data appendices and dashboards (together, the "Site"). By using the Site you agree to these terms. If you do not agree, please do not use it.

1. What the Site is

The Site publishes research, data-quality work and analysis about prediction markets and the crypto prices they settle on. It is for information and research only.

  • Nothing on the Site is investment, trading, legal or tax advice, or a recommendation to buy or sell anything.
  • We do not place trades for anyone, take deposits, manage money or run accounts.
  • We do not tailor anything on the Site to your situation. Any decision you make is yours.
  • Prediction markets carry a risk of loss, including the loss of everything you put in. Past results, real or hypothetical, do not predict future results.

2. Hypothetical results

Backtests, simulations and model results on the Site are hypothetical and are labelled that way. They carry this notice, required by CFTC Rule 4.41:

3. Access

Parts of the Site are a private preview open by invitation. Do not share your login, get around our access controls, or let anyone else use your access. We may approve, limit or end access at any time.

4. How you may use the Site

You may read the Site and use what you buy for your own internal research. You may not:

  • copy, resell, republish or redistribute Site content, data or files, except short quotes with credit to Jenkins & Jones;
  • scrape, crawl or bulk-download the Site, or put an unreasonable load on it;
  • reverse engineer the Site or try to reach anything you have not been given access to;
  • use the Site to break any law or any market's rules.

5. Third-party data

Some analysis uses market data from exchanges, venues and index providers. That data belongs to those providers and stays subject to their terms. We do not sell or redistribute raw third-party market data, except under a licence from the provider. Nothing on the Site gives you a licence to it.

6. Our content

We own the Site, its text, code, analytics, datasets we compile, and the Jenkins & Jones name and mark. Apart from the limited use in Section 4, these terms give you no rights in them.

7. Purchases

Prices are shown before you pay. Payments are handled by Stripe. Digital files are delivered by download or email. If a file you bought is missing or does not open, email us within 14 days and we will fix it or refund you. Consulting and custom work are covered by their own written agreement, which controls if it conflicts with these terms.

8. Accuracy and availability

We work to keep the Site accurate, and we publish known data gaps. Even so, the Site is provided "as is" and "as available". Data can be late, incomplete or wrong, and the Site may go down. To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

9. Limits on liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for any trading loss or lost profit. Our total liability for any claim about the Site is limited to the greater of what you paid us for the Site in the 12 months before the claim or US$100. Nothing here limits liability that the law does not allow us to limit.

10. Your responsibility

If you misuse the Site or break these terms and a third party makes a claim against us because of it, you will cover our reasonable costs of that claim.

11. Changes and ending

We may update these terms by posting a new version with a new effective date. Continued use after that means you accept the update. We may suspend or end your access if you break these terms. Sections 4 to 10 and 12 continue after access ends.

12. Law and disputes

Arizona law governs these terms, without regard to its conflict-of-law rules. Please email us first so we can try to settle any dispute. Any lawsuit must be brought in the state or federal courts in Maricopa County, Arizona.
